Release of Federal Title IX Rules

In November 2018, the U.S. Department of Education issued a proposal to amend the regulations implementing Title IX of the Education Amendments of 1972. The proposed regulations focused on sexual harassment (including sexual assault) and were intended to replace prior guidance issued by the Federal Government in the last several years.

The new regulations were released on May 6th (view them here), generating widespread media reports about drastic changes to how campuses would administer Title IX – to include speculation that university employees would no longer have the mandated duty to report incidents of sexual harassment and misconduct.

The purpose of this notification is to inform the HSU campus community that the current CSU Executive Orders that address Title IX (EO 1096 / EO 1097, March 29, 2019) remain in effect.  CSU employees maintain the same mandated duty to report incidents of sexual harassment and misconduct that they held prior to the release of the new regulations.

The systemwide Title IX Office and Office of General Counsel are currently evaluating the amended Federal Title IX Rules and will advise campuses on their implementation in the coming weeks and months.  The Rules require implementation by August 14, 2020; however, it is possible they will be challenged in court, which could delay implementation. 

In short, we know that changes to Title IX are coming, but they are not here yet.
